Terms and Conditions ("Terms")

These Terms and Conditions ("Terms") govern your use of the Capital Upfitters website (the "Service") operated by Empire Group Inc. as well as any services provided by Capital Auto Upfitters, Patriot Liner Rockville, Capital Protective Coatings, or any other trade name affiliated with Empire Group Inc.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. No Refunds Policy

By utilizing our services, you agree to our No Refunds policy. This policy ensures that all transactions are final and non-refundable under any circumstances, supporting our commitment to providing high-quality service.

2.2 Scope of Services
Our services covered under this policy include, but are not limited to:

  • Undercoating & Rustroofing
  • Receiver Hitches & Towing
  • Auto & Truck Accessories
  • Fleet Upfits & Management

2.3 Service Agreement

  • Service Quality: We guarantee the quality of our work, using premium materials and parts. Our technicians are highly trained and experienced to ensure top-notch service for your vehicle.
  • Customer Approval: Before starting any work, we will provide a detailed estimate and obtain your approval. Your review and confirmation constitute an agreement to the terms and associated costs.
  • Final Sale: Once a service is completed and the vehicle is returned to you, the transaction is considered final. No refunds will be provided for any services rendered, including labor, parts, or materials.
  • Non-Refundable Deposits: Deposits required for certain services are non-refundable, representing our commitment to reserving time and resources for your vehicle.
  • Warranty and Aftercare: While we do not offer refunds, we provide a warranty on our workmanship and the parts used. Should any issues arise related to the provided service, please contact us promptly, and our team will assess and address any legitimate concerns within the warranty period.
  • Custom and Cosmetic Services: Bespoke customizations and cosmetic services, such as vinyl wrapping, wheel repair, and caliper painting, are tailored to your specifications. Due to their personalized nature, these services are non-refundable.

2.4 Agreement Acknowledgment
By reviewing this policy on our website or receiving a service from us, you acknowledge and agree to the terms set forth in our No Refunds policy. This acknowledgment is implicit and does not require further signature or confirmation.

3. User Responsibilities

By using the Service, you agree to:

  • Provide accurate information during appointment booking and for any services rendered.
  • Adhere to all terms, including rescheduling policies, outlined in this document.
  • Comply with Maryland state and Montgomery County laws applicable to the use of the Service.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Capital Upfitters and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and Maryland. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Capital Upfitters.

5. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Capital Upfitters. Capital Upfitters has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge that Capital Upfitters shall not be responsible or liable for any damage or loss caused by reliance on such content, goods, or services available through third-party sites.

6. Appointment Rescheduling, Missed Appointments, and Right to Decline Service

6.1 Rescheduling Policy
To reschedule your appointment, please provide at least 24 hours' notice. If an appointment is rescheduled with less than 24 hours' notice or rescheduled a second time, a $150 rescheduling fee will apply.

6.2 Missed Appointments
If an appointment is missed without prior notice, a non-refundable safety deposit will be required to reschedule. For repeated missed appointments, an additional safety deposit may be required for each future booking.

6.3 Right to Decline Service
Capital Upfitters reserves the right to cancel, decline, or refuse service at any time and for any reason, including but not limited to repeated missed appointments, non-compliance with these Terms, or other reasons deemed necessary by our discretion. In compliance with Montgomery County and Maryland laws, Capital Upfitters will provide a notice to the user if a service cancellation occurs due to policy non-compliance or other stipulated reasons.

7. Deposits

All deposits are non-refundable and apply to services requiring advance booking or special orders. Cancellations after a deposit has been made will not result in a refund, as deposits cover the time, labor, and materials reserved for the service.

8. Labor and Parts Warranty

8.1 Labor Warranty
All work orders come with a 6-month labor warranty covering labor performed. This warranty does not extend to parts or materials unless specified otherwise.

8.2 Parts Warranty
For new parts, warranty coverage follows the manufacturer's policies. Used or customer-supplied parts do not carry any warranty from Capital Upfitters. Customers are responsible for verifying part fitment. Installed parts, electrical components, special order parts, and opened packages are not eligible for return.

9. Returns
Once a part is installed, all sales are final. Installed parts cannot be returned, refunded, or exchanged.

10. Limitation of Liability

To the fullest extent permitted by Maryland and Montgomery County law, Capital Upfitters shall not be liable for any loss or damage to your vehicle, including loss of items left in the vehicle, due to fire, theft, or other causes beyond our control. We are not responsible for delays caused by the unavailability of parts or delays in part delivery. All claims regarding liability must adhere to Maryland's statute of limitations and other applicable state and county regulations.

11. Compliance with Maryland and Montgomery County Law

Capital Upfitters complies with Maryland and Montgomery County laws regarding consumer rights, privacy, and protections. Users may request information about these Terms and their rights under Maryland and county laws. For further information, you may consult the Maryland Department of Labor, Licensing, and Regulation (DLLR) or Montgomery County’s Office of Consumer Protection.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before new terms take effect. The determination of a material change will be at our sole discretion.
